By accessing or using our Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Services.

1. Access & Eligibility

You confirm that you are at least 18 years old or the age of majority in your jurisdiction. You agree that the information you provide (contact, billing, shipping) is accurate and complete. You are responsible for keeping your account login details secure.

2. Products

We aim to display product information, descriptions, and colours as accurately as possible. However, variations may occur due to device settings or manufacturing differences.

We may modify, limit, or discontinue products at any time without notice.

3. Orders

By placing an order, you make an offer to purchase. We reserve the right to accept or decline any order at our discretion.

An order is deemed accepted when payment has been successfully processed and you receive an order confirmation email.

All mandatory fees and charges applicable within the UK (including product price, delivery charges, and any other compulsory costs) are displayed clearly before you complete your order. We do not add undisclosed mandatory charges at a later stage of checkout.

If we must cancel or amend your order (e.g. out of stock, pricing error), we will contact you using the details provided at checkout. If payment has been taken and we cancel, you will receive a full refund.

Purchases are intended for personal use only and not for resale.

4. Shipping & Delivery

Shipping is provided in accordance with our Shipping Policy. Delivery timeframes are estimates only and not guaranteed.

We are not responsible for delays caused by events beyond our reasonable control (e.g. carrier delays, weather, strikes).

5. Import & VAT

5.1 Shipment Origin: You acknowledge that goods ordered via this website are shipped directly by a third-party fulfillment partner located outside the United Kingdom and the European Union. The goods do not enter the commerce stream within the UK or EU via Marcella Haus or MS INDUSTRIES LLC.

5.2 Place of Supply and VAT: Marcella Haus is not VAT-registered in the United Kingdom and does not charge UK VAT on your order. Prices displayed are net of any VAT, import duties, customs clearance fees, or other levies applicable in your country of destination.

5.3 Import Costs and Delays: Any import VAT, duties, taxes, or fees levied upon the goods, and any delays, seizures, or non-delivery resulting from our fulfillment partner's failure to comply with import regulations or to pay any required import costs, remain the responsibility of the relevant party under the shipment method described below. This does not affect your statutory rights under UK consumer law where goods are not delivered, are misdescribed, or are otherwise not as agreed.

5.4 Method of Shipment: Our third-party fulfillment partner is responsible for shipment of the goods on a Delivered Duty Paid (DDP) basis, meaning all applicable fiscal duties are included within that shipment method.

6. Returns & Refunds

Returns and refunds are handled according to our Refund Policy, which forms part of these Terms.

Nothing in these Terms affects your statutory rights under UK consumer law, including your rights under the Consumer Rights Act 2015.

7. Reviews

We do not post, commission, or facilitate fake or misleading reviews of our products or Services, and we take reasonable and proportionate steps to prevent such reviews from appearing where reviews are enabled on our site, in line with the Digital Markets, Competition and Consumers Act 2024.

8. Intellectual Property

All content on www.marcellahaus.com – including text, images, graphics, logos, and layouts – is owned by Marcella Haus or its licensors.

You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written consent.

All trademarks, product names, and designs remain the property of their respective owners.

9. Third-Party Tools & Links

We may provide access to third-party tools or link to third-party websites. Use of such tools or sites is at your own risk. We are not responsible for their content, terms, or policies.

10. Relationship with Shopify

Our store is hosted on Shopify. Shopify provides the e-commerce platform but is not a party to your contract of sale with us.

All purchase, delivery, refund, and support obligations are solely between you and Marcella Haus.

11. Prohibited Uses

You agree not to use the Services:

for any unlawful purpose to violate any applicable laws or regulations to infringe upon our or others' intellectual property rights to transmit malicious code, malware, or harmful content to collect personal information of others without consent to interfere with or disrupt the operation of the website We may suspend or terminate access if we suspect misuse.

12. Disclaimer of Warranties

Except where required by law, the Services and products are provided on an "as is" and "as available" basis.

We do not guarantee that the website will be uninterrupted, timely, secure, or error-free.

13. Limitation of Liability

Nothing in these Terms excludes or limits liability for:
